Terms and Conditions

1. Agreement

By purchasing, subscribing to, or using any service offered by Cyber Safe Security, LLC (“Cyber Safe Security,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions. Please read them carefully before completing your purchase or activating your subscription.

2. Services

Cyber Safe Security provides managed cybersecurity services, including but not limited to threat monitoring, managed incident response, identity protection, and endpoint protection, delivered through our technology partners and service providers. The specific services included in your subscription are outlined in your selected service plan at the time of purchase.

3. Free Look Period

All new subscriptions include a thirty (30) day free look period beginning on the date of enrollment. During this period, the Client may evaluate the services at no charge. If the Client is not satisfied for any reason during the free look period, they may cancel their subscription by providing written notice to Cyber Safe Security before the expiration of the thirty (30) day free look period and no charges will be incurred.

Services activated and used during the free look period are subject to all other terms and conditions stated herein. Upon expiration of the free look period without cancellation, the Client’s annual subscription will activate and the full annual payment will be due and processed.

4. Subscription and Billing

4.1 Annual Subscriptions

All subscriptions are offered on an annual basis only. Upon expiration of the thirty (30) day free look period, the full annual subscription fee is billed in advance and covers a twelve-month service period from the date of activation.

4.2 Non-Refundable Payments

All annual subscription payments are non-refundable. Once the free look period has expired and the annual subscription has been activated, the full annual payment for the subscription period is non-refundable regardless of the date of cancellation, downgrade, or termination. No exceptions will be made.

4.3 Per Unit Pricing

Subscriptions are priced per user seat. Each user seat covers the devices and services outlined in your selected service plan. Additional user seats may be added at any time at the current per-unit annual rate. Additional seats added mid-year will be prorated to align with the Client’s existing annual renewal date.

4.4 Renewal

Annual subscriptions renew automatically at the end of each twelve-month subscription period at the then-current annual rate unless the Client provides written cancellation notice in accordance with Section 5 of these Terms and Conditions.

5. Cancellation Policy

5.1 Cancellation During Free Look Period

A Client may cancel their subscription at any time during the thirty (30) day free look period by providing written notice to Cyber Safe Security. No charges will be incurred and no payment will be processed.

5.2 Cancellation After Free Look Period

To cancel an annual subscription after the expiration of the free look period, the Client must provide written notice to Cyber Safe Security a minimum of thirty (30) days prior to the annual renewal date. Notice must be submitted in writing by email to the designated Cyber Safe Security contact address provided at the time of enrollment.

5.3 Effect of Cancellation

Upon receipt of a valid cancellation notice, services will continue through the end of the current annual subscription period. No refund of any portion of the annual subscription payment will be issued. The subscription will not renew at the end of the current annual period.

5.4 Failure to Provide Notice

If a Client fails to provide the required thirty (30) day written cancellation notice prior to the annual renewal date, the subscription will automatically renew and the Client will be responsible for the full annual payment for the renewed subscription period.

6. Non-Refundable Payments

All annual subscription fees paid to Cyber Safe Security are non-refundable upon expiration of the thirty (30) day free look period. This includes but is not limited to payments made for annual user seat subscriptions, onboarding fees, and any prepaid service periods. The non-refundable nature of annual payments applies regardless of the reason for cancellation, including but not limited to business closure, change of service provider, or dissatisfaction with services received.

7. Client Responsibilities

• Provide accurate and complete information at the time of enrollment and maintain current billing and contact information throughout the subscription period
• Cooperate with Cyber Safe Security and its technology partners, including Vijilan or similar providers and CrowdStrike or similar providers, during onboarding, deployment, and ongoing service delivery
• Ensure that devices covered under the subscription are made available for agent installation and configuration as required
• Notify Cyber Safe Security promptly of any changes to the number of users, devices, or business locations covered under the subscription
• Use the services provided solely for lawful business purposes

8. Service Availability

Cyber Safe Security delivers services through its technology partners and service providers. While we are committed to providing continuous, uninterrupted service, we do not guarantee that services will be free from interruptions, errors, or delays caused by factors outside our reasonable control, including but not limited to third-party platform outages, internet service disruptions, or force majeure events.

9. Limitation of Liability

Cyber Safe Security’s liability to the Client for any claim arising out of or related to these Terms and Conditions or the services provided shall not exceed the total fees paid by the Client to Cyber Safe Security in the three (3) months immediately preceding the event giving rise to the claim. Cyber Safe Security shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of the use of or inability to use our services.

10. No Guarantee of Security

Cyber Safe Security provides managed cybersecurity services designed to detect, respond to, and reduce the risk of cyber threats. However, no cybersecurity solution can guarantee complete protection against all threats. Cyber Safe Security does not warrant or guarantee that its services will prevent all security incidents, data breaches, or cyberattacks.

11. Confidentiality

Cyber Safe Security agrees to maintain the confidentiality of all Client data and information accessed in the course of providing services. We will not sell, share, or disclose Client information to third parties except as required to deliver the services outlined in your subscription or as required by law.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising out of or related to these Terms and Conditions shall be resolved in the courts of Orange County, Florida.

13. Changes to Terms and Conditions

Cyber Safe Security reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of material changes by email at least thirty (30) days prior to the effective date of the changes. Continued use of our services following notice of changes constitutes acceptance of the updated Terms and Conditions.
